Important information for guests joining Arctic Cruise In Norway AS (ACIN) day cruises, overnight experiences, Ski & Sail expeditions and yacht charters.
For information about insurance relating to our vessels and the mandatory charge on weekly charters, please see Yacht Insurance & Charter Protection .
ACIN offers professionally operated day cruises, private and overnight voyages, crewed charters and, on selected sailing catamarans, bareboat charters subject to approval.
On an ACIN-operated voyage, ACIN is responsible for the maritime services it agrees to provide and for its applicable legal and safety obligations. The appointed skipper is responsible for the safe navigation and operation of the vessel.
On a genuine bareboat charter, the charterer takes possession of the yacht without an ACIN skipper or crew. The charterer must appoint an appropriately qualified skipper, and the allocation of operational duties and liabilities is governed by the charter agreement and applicable law. ACIN remains responsible for duties that cannot lawfully be transferred or excluded.
Unless expressly included in the booking, vessel crew do not act as mountain guides, ski instructors, diving instructors or supervisors of independent activities ashore or in the water.
Ski touring, backcountry skiing, mountaineering and winter travel involve hazards including avalanches, changing weather, difficult terrain and limited access to rescue services.
Guests must use suitable equipment, act within their abilities and follow instructions given by any appointed professional guide. An independently arranged mountain activity remains the responsibility of the participants and their separately contracted guide, subject to applicable law.
Where a mountain guide or guided activity is included in an ACIN package or expressly contracted through ACIN, the responsibilities of ACIN and the guide are determined by that arrangement and applicable law. The vessel skipper does not automatically assume the professional role of the mountain guide.
Mountain route selection, avalanche assessment and decisions to continue or turn back must be made by the appropriately responsible guide or, for genuinely independent activities, by the participants themselves.
Guests may independently choose to hike, cycle, climb, swim, kayak, explore coastal communities or undertake other activities away from the vessel. Guests should assess their own fitness, skills, equipment and the prevailing local conditions.
ACIN does not supervise independently organised shore activities unless supervision or guiding forms part of the agreed service. This does not remove any responsibility ACIN may have for services it provides, arrangements it makes or duties imposed by law.
On a crewed voyage, guests must agree safe embarkation and return arrangements with the skipper. On bareboat charters, these arrangements are managed by the charterer's appointed skipper.
Cold-water activities carry serious risks, including hypothermia, currents, waves, limited visibility, fatigue and interaction with wildlife. Participation may require additional skills, equipment, guidance and activity-specific insurance.
Guests must accurately disclose relevant experience and follow the safety instructions of the responsible operator or guide. Activities offered as part of an ACIN-organised programme are delivered subject to the agreed scope of services, operational safety procedures and applicable law.
Where an activity is booked independently with a third-party operator, that operator's terms and responsibilities may also apply. ACIN does not provide diving tuition or in-water supervision unless specifically agreed and organised.
All charter and expedition guests are required under ACIN's booking conditions to arrange suitable personal travel insurance before departure. Day-cruise guests are also strongly advised to maintain appropriate personal travel insurance; any booking-specific requirements will be stated before purchase.
The policy should reflect the length and nature of the trip. Guests taking part in specialist activities must confirm directly with their insurer that those activities are covered.
Where relevant, guests should verify protection for:
Policy exclusions, geographic limits and activity definitions vary. Insurance purchased for an ordinary holiday may not cover specialist Arctic activities.
ACIN's vessel and marine liability insurance is not a substitute for a guest's own travel, medical, cancellation or activity-specific insurance. ACIN does not issue individual travel insurance policies to guests.
ACIN may request evidence of appropriate cover where this is a condition of the booked expedition or activity. Any consequences of failing to meet a disclosed booking requirement will be governed by the applicable booking terms and law.
All participants must behave responsibly, carry appropriate clothing and equipment, respect local laws and follow safety directions from the person responsible for the relevant activity.
Routes, anchorages, boarding arrangements and activities may be changed or suspended where necessary for safety. Contractual rights following such changes are governed by the booking terms and applicable law.
Guests are responsible for their own conduct and decisions during genuinely independent activities. Independent providers may have separate contractual duties and liabilities for services booked directly with them.
Nothing on this page excludes or restricts ACIN's liability for its own negligence, breach of contract, mandatory maritime or safety duties, or any other liability that cannot lawfully be limited. Responsibility for any incident depends on the facts, the agreed services and applicable law.
This page provides safety and insurance information; it does not replace the applicable booking contract, charter agreement or legally mandatory consumer rights.
By booking an experience, the contracting customer acknowledges that the activity descriptions, relevant safety instructions, insurance requirements and booking conditions must be reviewed before participation. The booking customer should share relevant information with all members of the group.
For bareboat charters, the charterer and appointed skipper must additionally satisfy the separate qualification, handover, safety and contractual requirements before the yacht is released.
These conditions are interpreted under Norwegian law, including applicable maritime, consumer protection and package travel legislation. Mandatory legal rights and obligations prevail in the event of any inconsistency.
