Terms of Contract

Weekly Yacht Charter & Bareboat Charter — Arctic Cruise In Norway AS

Tromsø, Norway | Draft revision: 3 November 2026 | Subject to review and signed booking-specific terms

Important: This page describes general charter terms. The signed charter agreement and booking confirmation must specify the agreed price, VAT treatment, vessel, skipper arrangement, cancellation schedule, insurance documents and all booking-specific conditions. Mandatory law always prevails.

1. Parties and Charter Details

This Charter Agreement is entered into between Arctic Cruise In Norway AS ("ACIN"), Brinkvegen 41, 9012 Tromsø, Norway, and the Customer identified in the signed booking confirmation or charter agreement.

The signed charter agreement and booking confirmation specify the vessel, charter type, dates, services and agreed prices. Any discrepancy must be resolved in writing before signing.

2. Charter Price, VAT and Payment

All charter prices are quoted in EUR. The signed agreement must separately state the charter price excluding VAT, the applicable VAT rate and amount, and the total including VAT. ACIN currently applies 25% VAT to bareboat charter, subject to the correct legal classification of the specific supply. Skipper services, accommodation and other services must be itemised and assessed separately; no single VAT rate is assumed to apply to every service.

Payment schedule: 30% within five days of signing; 60% no later than 30 days before embarkation; and the remaining 10% no later than five days before embarkation. For bookings made inside these deadlines, the payment schedule must be agreed in writing. ACIN may suspend confirmation or cancel for material non-payment after reasonable notice, subject to applicable law.

The charter price excludes diesel, fuel, gas, harbour/quay fees, food and beverages unless expressly included. Taxes already included in an agreed VAT-inclusive price shall not be charged again.

3. Security Deposit and Extras

For Arctic Princess and Arctic Charm, the standard refundable security deposit is EUR 4,500 per vessel, unless the signed agreement states otherwise. The deposit is separate from charter payments and the mandatory charter insurance fee. It is payable before handover by an agreed payment method. ACIN may make documented deductions for damage, loss, unpaid charges or other amounts for which the Customer is legally and contractually responsible. Any balance shall be returned within a reasonable period following inspection and reconciliation; an itemised explanation shall be provided for deductions.

Obligatory extras: end cleaning EUR 375 for Arctic Princess / Arctic Charm, EUR 465 for Arctic Dream; bed linen EUR 35 per person; gas EUR 55 per 5 kg bottle, where applicable.

Optional extras: dinghy with engine EUR 475 per week; complete fishing equipment (five units) EUR 225 per week. Extras and their applicable VAT treatment shall be confirmed in the booking summary.

4. Mandatory Charter Insurance Fee

For weekly and longer eligible yacht charters, ACIN charges a mandatory charter insurance fee of EUR 250 per booking, separately itemised in the charter agreement or invoice. It does not automatically apply to day charters, and Arctic Queen is not offered as a weekly bareboat charter under this provision.

This fee is separate from the refundable security deposit and from the Customer's own travel insurance. The fee does not by itself establish that damage, cancellation, excess, medical treatment or any particular risk is covered. Actual cover, exclusions, deductibles, insured parties and claims procedures are determined by the relevant insurance policy and documents provided for the booking.

Read the related information at Mandatory Charter Insurance and Yacht Insurance & Charter Protection. If these descriptions differ from the applicable policy, the policy governs the insurance cover, subject to mandatory law.

5. Personal Travel and Activity Insurance

All charter and expedition guests must arrange suitable personal travel insurance before departure. This should address emergency medical treatment, repatriation, cancellation or interruption and the particular activities planned. Guests taking part in Ski & Sail, off-piste skiing, mountaineering, whale-related water activities, snorkelling, kayaking or other specialist activities must check directly with their insurer that those activities are covered.

ACIN's vessel and marine liability insurance is not a substitute for individual travel, medical, cancellation or activity-specific insurance. ACIN does not issue individual travel insurance policies. Evidence of appropriate insurance may be requested where disclosed as a booking requirement.

6. Bareboat, Crewed Charter and Skipper Qualifications

For a genuine bareboat charter, the Customer takes possession of the yacht without an ACIN skipper or crew and appoints a suitably qualified skipper. The skipper's licence and qualifications must be submitted and accepted under the applicable insurer's and ACIN's requirements before the booking is finally confirmed and the yacht is released. The charterer and skipper must comply with handover, navigation and vessel safety procedures.

On an ACIN-operated or crewed voyage, the appointed skipper is responsible for safe navigation and vessel operations. On bareboat charters, the charterer's approved skipper assumes operational responsibilities under the agreement and applicable law. ACIN retains any legal obligations that cannot be transferred or excluded.

Unless expressly included in the booking, vessel crew are not mountain guides, ski instructors, diving instructors or supervisors of independent activities ashore or in the water.

7. Booking and Cancellation

The booking becomes binding in accordance with the signed agreement and confirmation. The Customer must provide accurate passenger, contact and skipper details and meet payment deadlines.

Cancellation schedule: The existing contract refers to a non-refundable NOK 40,000 amount, a 50% refund linked to the 60% instalment, and separate rules within five days of departure. These provisions are not sufficiently clear for automatic incorporation into a new EUR-denominated contract. The applicable cancellation fees, dates, refund calculation and any rescheduling credit must therefore be expressly stated in the signed booking confirmation before payment. Until confirmed in writing, no unspecified cancellation charge is created by this section. Mandatory consumer rights prevail.

Any request to change dates or reschedule is subject to written agreement, availability and the cancellation/rescheduling terms stated in the signed booking confirmation.

8. Vessel Delivery and Return

ACIN will deliver the agreed vessel at the agreed place and time, in working order, equipped and furnished as specified. A condition and inventory check should be completed at handover and return.

If ACIN cannot deliver the vessel as agreed, it will promptly notify the Customer and propose a suitable alternative, proportionate price reduction or other remedy required by the agreement and applicable law. The previous 24-hour/48-hour thresholds may be used only if expressly retained in the signed contract and consistent with mandatory rights.

The Customer shall return the vessel at the agreed location and time, with reasonable allowances for safety and circumstances beyond the Customer's control. Any late-return charge must be proportionate, disclosed in advance and legally enforceable; the former automatic double daily rate is not applied without express agreement.

9. Safety, Weather and Activities

Safety takes precedence over the planned itinerary. The responsible skipper may amend routes, anchorages, departure times or activities for navigational and safety reasons. Bad weather is not automatically force majeure; the legal and contractual consequences depend on the circumstances and the services agreed.

Ski touring, mountain activities and cold-water activities carry specific hazards. Where a professional guide is included, their duties follow the agreed service and applicable law. For genuinely independent activities, participants must assess their abilities, equipment and conditions, without excluding ACIN's non-transferable legal responsibilities.

All passengers and crew must be registered before sailing using the Passenger & Crew List. Guests must follow relevant safety instructions. The Lagoon User Guide must be reviewed where applicable.

10. Use of the Yacht and Customer Responsibility

The yacht may be used only for the agreed lawful private or charter purpose. The Customer may not sub-charter the vessel, carry passengers or goods for hire, or enter commercial arrangements involving the vessel or crew without ACIN's prior written consent and any necessary regulatory approvals.

The Customer and guests shall comply with applicable laws, avoid prohibited substances and weapons, and follow reasonable onboard rules. Animals require prior written permission. Smoking is restricted to outdoor areas expressly permitted by the skipper. Stiletto heels and shoes with marking black soles are not permitted onboard.

The Customer is responsible for damage, loss or other liability caused by the Customer or guests to the extent provided by the agreement and applicable law. ACIN is responsible for its own obligations, including negligence and duties that cannot lawfully be excluded.

11. Breakdown, Delays and Force Majeure

ACIN will take reasonable steps to remedy a breakdown or disablement. If the yacht cannot be used for a material part of the charter for reasons not attributable to the Customer, the parties will assess appropriate remedies, which may include a replacement vessel, extension, price reduction or refund, subject to the signed agreement and applicable law.

Neither party is responsible for failure caused by an event genuinely beyond its reasonable control to the extent recognised by applicable law. Ordinary adverse weather does not automatically remove refund or performance obligations.

12. Navigation, Harbour Charges and Gratuities

The appointed skipper must ensure that appropriate, current navigational information and charts are available for the intended voyage and that all statutory requirements are met. See Norwegian Mapping Authority chart information. This contract does not claim that paper charts are the only legally valid navigation reference.

Harbour dues, fuel and other agreed operating expenses are payable by the Customer when expressly excluded from the charter price. Applicable taxes must be transparently itemised and must not be charged twice.

Gratuities are voluntary and not included in the charter price. A suggested 10% gratuity is not a contractual obligation.

13. Notices, Governing Law and Disputes

Notices and material changes should be communicated in writing to the addresses stated in the booking confirmation. Norwegian law applies, including applicable maritime, consumer and package travel legislation. Nothing in these terms excludes rights or obligations that cannot lawfully be waived.

The parties should first attempt to resolve disputes amicably. Any dispute forum or arbitration agreement must be separately assessed for enforceability, especially where the Customer is a consumer. These terms do not impose mandatory pre-dispute arbitration on consumers.

14. Signatures and Acknowledgement

By signing, the parties confirm that they have reviewed the charter description, applicable insurance documents, pricing, VAT, security deposit, payment schedule, cancellation conditions and safety requirements.
